As you know, the City of Seattle adopted a Paid Sick and Safe Leave Ordinance in September 2011, to take effect September 1, 2012. For the same reason that SHRM national opposed the national legislation, Seattle SHRM opposed the Ordinance: SHRM opposes all government mandated benefits because they reduce workplace flexibility; HR professionals are in the best position to utilize their acquired skills, knowledge and judgment to determine the most appropriate mix and structure of pay and benefits for their particular organization.
In late 2011 and early 2012, as businesses began preparing for the implementation of the Ordinance, the enormity of the cost of tracking employees and administering the paid leave became apparent. The business community began to look for legal grounds to attack the ordinance. One legal challenge was recently filed in the Western District of Washington by BNSF Railway Company based primarily on the Railway Labor Act and, if successful, will likely impact primarily those industries affected by the Act. A broader-based constitutional challenge to the Ordinance with a reasonable likelihood of success is possible and would impact more if not all industries.
